Rental Rules - This waiver agreement shall be governed under the laws of the State of Maine. North Haven Rentals reserves the right to terminate any rental at any time. *

The boat will have a full tank of gas when rental period begins, LESSEE must refill it before returning. If returned less than full, a fueling fee of $25 PLUS the cost of gas to refill the tank will be charged to LESSEE’s credit or debit card.

If rental boat is returned by LESSEE in a excessively dirty condition a cleaning fee of $75. will be charged.

LESSEE shall return the boat to its mooring in the Fox Island Thoroughfare each night before dark, unless otherwise instructed or agreed upon by LESSOR and LESSEE. LESSEE is responsible for seeing to proper and safe securing of lines, whether to mooring or float.

If arrangments have been made with the LESSOR to moor the rental boat in another location LESSEE acknowledges his/her responsibility for the safe and proper mooring/tying of the craft, and for the safety of the craft overnight. It is AGREED AND UNDERSTOOD BY LESSEE that the LESSOR shall not be held liable for damages inconvenience or time lost caused by sinking, water infiltration, hull damage, etc. due to improper securing of lines etc.

In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental boat the LESSEE will immediately report it to LESSOR by telephone at 207.867.2282 or 207.867.4621 or by hailing Brown’s Boatyard on VHF Radio on Channel 16. Continued use of boat shall be entirely at the LESSEE’s risk.

The boat shall remain within the boundaries designated on the Rental Chart (these boundaries include the Fox Islands and nearby waters and islands.) The Rental Chart shall remain in the boat and is labeled “Rental Chart”.

LESSEE shall be the sole operator of the boat during rental period; up to two (2) additional operators can be added at a rate of $20 per day in addition to the Rental Rate. LESSEE remains sole party responsible for the boat during the course of the rental period and shall not carry passengers for hire at any time.

The LESSEE certifies that he/she is experienced and capable in all aspects of the handling and operation of the Boat; and acknowledges his/her responsibility for the safe and proper operation of the Boat, and for the safety and welfare of other boaters, persons, and passengers

If your rental is non-electric The LESSEE confirms that they understand all aspects of fueling the Boat, including any necessary oil(s) and/or additives for the motor used on Boat (2 or 4 stroke, gasoline or diesel.) LESSEE acknowledges that damage will result with improper fueling and further acknowledges that LESSEE will be responsible for any damage incurred due to improper fueling. If the LESSEE is uncertain or unfamiliar with fueling/fuel it is their responsibility to ask for clarification.

The LESSEE certifies that he/she upon examination of the Boat and all equipment and finds it acceptable and suitable for the purpose for which it is leased, and agrees to return the Boat in the same condition and with a full tank of gas as provided at the start of the rental period, and to contain all necessary lifesaving equipment, all of which is in proper working order.

The LESSEE agrees that operation of the boat in inclement weather, (I.e. fog, high winds) night operation, water skiing, towing, tubing are expressly forbidden as described in Rental Agreement.

The LESSEE certifies on penalty of law and forfeiture of any payment made that he/she will always operate the Boat within any and all United States Coast Guard regulations as well as any and all applicable local, state and federal laws.

The LESSEE agrees not to use, nor permit the use of the rental boat for any unlawful purpose; in a careless or negligent manner; while under the influence of liquor or narcotics; or any other drugs; by any other person not the signatory of the agreement, not at least 21 years of age; or after dark.

(THIS IS THE REALLY IMPORTANT RULE, PLEASE READ CAREFULLY) It is agreed and understood by the LESSEE (you) that the LESSOR (North Haven Rentals) shall not be held liable for damages, inconvenience, or time lost caused by accident, breakdown, or malfunction of the rental boat. LESSEE acknowledges his/her full financial responsibility for any and all damage and or repairs to the boat and or equipment provided by LESSOR. LESSEE may also be responsible for loss of rental income for the LESSOR. If the damage precludes use by subsequent LESSEES. LESSEE further agrees to indemnify and hold harmless the LESSOR from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation, or possession of said rental boat. LESSEE further agrees to hold the LESSOR harmless should loss or damages occur to any of LESSEE’s personal property while carried in, or on, the Boat, including loss or damage by fire, water, theft, or any other causes whatsoever.

LESSEE expressly agrees to indemnify and hold LESSOR harmless of, from and against any and all loss, cost, damages, attorney fee and/or liability in connection with the enforcing of the forgoing rental contract by LESSOR, including expense incurred in connection with attempting to collect delinquent rent and in the event of suit by LESSOR, to recover possession of said rental property and/or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue and any Action hereunder shall be in the county of LESSOR

THIS IS THE IMPORTANT RULE, PLEASE READ CAREFULL) I am (We are) responsible for the replacement of the full retail value of the bike, and of any parts or equipment rented under this agreement that is not returned or is damaged during my/our use. This includes but is not limited to broken chain, brakes, cables, pedals, handlebars, lights, fenders, seats, reflectors, baskets, cargo rack, etc.

RELEASE OF LIABILITY, WAIVER OF CLAIMS ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. ASSUMPTION OF RISK I am aware that quick release mechanisms, brakes, and other parts of the Equipment will not function as optimally intended at all times and under all circumstances, and may be adversely affected by inclement weather conditions, moisture, terrain, and the like. I am aware that cycling, including off-road and mountain terrain cycling, involves risks, dangers and hazards including, but not limited to: mechanical and structural failure of the Equipment; changing weather conditions; variation or steepness in terrain; difficulty or inability to control one's speed and direction; loss of balance; rapid or uncontrolled acceleration on hills and inclines; collision with exposed rock, snow, ice, earth, trees, or other natural or man-made objects; collision with pedestrians, vehicles or other cyclists; changes or variations in the cycling surface; failure to cycle safely or within one's own ability; negligence of other cyclists; and NEGLIGENCE ON THE PART OF NORTH HAVEN RENTALSINC., ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND/OR SERVANTS, AND THE MANUFACTURERS AND DISTRIBUTORS OF THE EQUIPMENT, THEIR MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND/OR SERVANTS. I UNDERSTAND THAT MY USE OF THE EQUIPMENT, INCLUDING SAFETY EQUIPMENT, CANNOT GUARANTEE MY SAFETY OR FREEDOM FROM INJURY WHILE CYCLING. I AM AWARE THAT IT IS NOT POSSIBLE TO PREDICT EVERY CONDITION OR CIRCUMSTANCE UNDER WHICH THE EQUIPMENT AND SAFETY EQUIPMENT WILL NOT OPERATE AS INTENDED. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS, AND THE RESPONSIBILITY FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING THEREFROM. (ALL OF THE FOREGOING PARTIES REFERRED TO AS THE "RELEASEES") RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT In consideration of the rental of the Equipment, I hereby agree as follows: 1. To waive any and all claims that I have or may in the future have against North Haven Rentals, its members, directors, officers, employees, agents, and/or servants, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer, resulting from or arising out of any aspects of my use of the Equipment, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF WARRANTY ON THE PART OF THE RELEASEES in respect of the design, manufacture, selection, installation, maintenance, inspection, service or repair of the Equipment, or in respect of the provision of or the failure to provide any warnings, direction, instructions or guidance as to the use of the Equipment. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE EQUIPMENT LISTED ON THIS FORM ; 2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability from any damage to property of or personal injury to any third party, resulting from my use of the Equipment; 3. This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and representatives, in the event of my death or incapacity; 4. This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the State of PA and no other jurisdiction; and 5. Any litigation involving the parties to this Agreement shall be brought solely within the State of PA and shall be within the exclusive jurisdiction of the Courts of the State of ME. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND SIGN IT FREELY, VOLUNTARILY, AND WITH KNOWLEDGE OF ITS CONTENTS.
